No secondary PU result published: High Court direction to state government
In a major development, the Karnataka High Court on Thursday directed the state government not to announce the results of the secondary PU students until the decision of the government-appointed expert panel is taken.
BANGALORE : The Karnataka High Court on Thursday directed the state government not to announce the results of the secondary PU students in the line-up until a comprehensive panel of experts has been formed by the government.
This order was issued with all classes of students in mind, including repeaters.
The Divisional Bench of Justice BV Nagarath and Justice Pankate Sanjeev Kumar accepted the order after hearing the arguments of the government and the petitioners. The petition was filed by Jnan Mandir Education Trust, represented by SV Singhre Gowda, Managing Trustee of Bangalore.
The court verbally asked the government to put the freshers and repeaters on the same list so that the first PU results of the repeaters could be counted, except for the private students. The court said private students could take the test after their first PU scores were unavailable because of the covid condition.
Given the Kovid pandemic situation, the petitioners have gone to court on the grounds that the government's decision to pass secondary PU students without a test for the 2020-21 academic year is discriminatory. The court has sought a response from the government.
The state's lawyers informed the court that the state government had formed a panel of 12 experts to submit its recommendations to resolve the issue. Until then, the outcome could be postponed, the lawyers prayed to the court. Attorneys explained to the court the statistics of various classes of students, including freshers, repeaters and private candidates.
Meanwhile, the advocates for the applicant have contacted this court and said that they have applied for private candidates who have passed the first PU exam and those who did not pass the first PU exam.
After hearing the arguments, the court directed the state government to take a comprehensive decision, balancing the interests of all classes of students. The court said the state should not announce the results of the freshers, pending a hearing on July 5, 2021, when a comprehensive decision is pending.
